These Terms govern access to the SistematikoPH website and community forum. By using the website, or by registering after being asked to accept these Terms, you agree to them. If you do not agree, do not register or use interactive features.
Eligibility and accounts
You must be at least 18 years old and legally capable of entering an agreement. Account information must be accurate. You are responsible for safeguarding your password and activity under your account and must promptly report suspected unauthorized access.
Website information and project inquiries
Website content is general information, not a binding offer, professional advice, warranty, guaranteed outcome, or final specification. An inquiry does not create a client, fiduciary, or confidential relationship and does not require either party to proceed. Do not send confidential or regulated data before an appropriate agreement is signed.
Software engagements
Every engagement requires a separate written contract covering scope, fees and taxes, schedule, acceptance, change requests, client dependencies, intellectual property, third-party components, confidentiality, security, data protection roles, hosting, support, warranties, liability, termination, and dispute handling. If that contract conflicts with these website Terms, the signed contract controls for the engagement.
Acceptable use
You must follow our Community Guidelines and Acceptable Use Policy. You may not gain unauthorized access, probe or disrupt systems, introduce malicious code, impersonate others, harvest personal data, evade safeguards, publish unlawful or infringing content, or use the service in violation of Philippine law or another person’s rights.
User content and moderation
You retain ownership of content you submit. You grant SistematikoPH a non-exclusive, worldwide, royalty-free license to host, reproduce, format, display, and distribute public content only as needed to operate, secure, and promote the forum. You represent that you have the necessary rights to submit it. We may preserve, restrict, remove, or disclose content when reasonably necessary for moderation, security, legal compliance, or protection of users.
Our intellectual property
Unless stated otherwise, SistematikoPH and its licensors own the website software, design, brand, copy, graphics, and other materials. No ownership transfers to you. Limited personal viewing and normal website use are permitted; reproduction, resale, deceptive use, or commercial exploitation requires written permission. Third-party names and components remain the property of their owners.
Electronic communications
You agree that website submissions and notices may be made electronically, consistent with the Electronic Commerce Act of 2000. A transaction or software project becomes binding only as stated in a separate written agreement or accepted electronic record.
Third-party services
Links and integrations may lead to services we do not control. Their terms, availability, security, and privacy practices apply independently. A link does not imply endorsement.
Disclaimers and limitation
The public website and forum are provided on an “as available” basis. To the extent permitted by law, we disclaim implied warranties relating solely to this free informational website. We do not exclude liability that cannot lawfully be excluded, including liability arising from fraud, willful misconduct, or rights protected by applicable consumer law. To the extent permitted by law, we are not liable for indirect, incidental, or consequential losses caused by use of or inability to use the public website.
Suspension and termination
We may restrict or terminate access for material or repeated violations, security risk, legal requirements, or discontinuation of the service. Provisions concerning intellectual property, disclaimers, liability, and dispute handling survive where applicable.
Governing law and disputes
These Terms are governed by the laws of the Republic of the Philippines. The parties should first attempt good-faith informal resolution by contacting us. Subject to mandatory consumer rights and applicable rules on venue, disputes shall be brought before the proper courts of the Philippines.
Changes and contact
We may update these Terms prospectively. Material changes will be indicated by the “Last updated” date and, where appropriate, an additional notice or renewed acceptance. Questions may be sent to admin@sistematiko.tech.
